1. GENERAL INFORMATION

 

PARTIES: The seller of products on this website (the "Website") is RETAIL RESULTS LTD ("Finest Hampers") of Unit C, Valley Park, Olds Approach, Watford, Herts, WD18 9TL. PRICES AND TITLE: Title to goods supplied will remain with Finest Hampers until the later of delivery or all sums due from YOU having been paid in full.

 

PAYMENT METHOD: Finest Hampers accepts payment by most major credit/debit cards.

 

DEEMED ACCEPTANCE: By purchasing a hamper from Finest Hampers, you have indicated your acceptance that these terms and conditions apply.

 

AVAILABILITY: All Products shown on the Website are subject to availability.

 

PRIVACY: Finest Hampers's privacy policy and the other items contained in the legal notes to the Website are hereby incorporated into these terms.


2. ORDERING

 

ORDER PROCESS: All orders are subject to acceptance in accordance with these terms and conditions.

 

Finest Hampers accepts YOUR order and the contract is completed between YOU and Finest Hampers only on the despatch of the products ordered by YOU unless Finest Hampers has notified YOU that it does not accept YOUR order or the order has been cancelled.

 

PROBLEMS: Finest Hampers may decline an order where:

 

1. The Product YOU ordered is not in stock;

 

2. Finest Hampers cannot obtain authorisation for payment or there is a problem receiving YOUR payment;

 

3. There is a pricing or product description error;

 

4. YOU are otherwise ineligible to order from Finest Hampers;

 

If there are any problems with YOUR order, YOU will be contacted by Finest Hampers as soon as possible. Finest Hampers reserves the right to reject any offer to purchase by YOU at any time.

 

PLACING AN ORDER:

 

1. YOU place the order for the products YOU want through the Website by following the process on the Website.

 

2. Payment will be taken by Finest Hampers immediately YOUR card details are authorised by YOUR card provider.

 

3. YOUR order will be despatched in accordance with the delivery conditions selected by YOU in the ordering process.

 

4. We will acknowledge by email the products set out in YOUR order. This is not an order confirmation or order acceptance by Finest Hampers.

Finest Hampers reserves the right to withdraw any products from the Website at any time and/or alter any content on the Website. Finest Hampers may refuse a transaction for any reason at any time at its discretion.

 

LEGAL REQUIREMENTS: Before YOU can place an order with Finest Hampers You are legally obliged to:

 

1. provide YOUR name (as it appears on your credit cards, driving licence etc), phone number, e-mail address, payment details and other information requested in the Website;

 

2. Be over 18 years of age to make a purchase which includes an alcoholic product;

 

3. Stipulate a full postal delivery address in the United Kingdom which must be a permanent residence or active business premises;


3. PAYMENT

 

VAT: All prices and delivery charges are shown inclusive of VAT (where applicable). VAT rates are available separately and are correct at the time of placing on the Website. The total cost of YOUR order is the price of the products ordered plus delivery charges. Delivery charges are specified on the Website. Payment can be made by the methods specified in the Website.

 

CARD DETAILS: By placing YOUR order, YOU confirm that the credit or debit card that is being used is YOURS. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer and by placing YOUR order YOU expressly consent to the transfer of your data necessary to securely process the transaction. If the issuer of YOUR payment card refuses to or does not, for any reason, authorise payment to us, Finest Hampers will not be liable for any delay or non-delivery.


4. SERVICE AND PRODUCTS

 

QUALITY: YOUR satisfaction is paramount for Finest Hampers. Finest Hampers uses expert buyers to select products of the highest quality for the Website. Finest Hampers's buyers choose only the finest quality produce. Contact the CUSTOMER ENQUIRES for a replacement or refund on any item which does not arrive in good condition or is lost in transit.

 

SUBSTITUTION: While photography and descriptions are intended to be accurate, Finest Hampers reserves the right to substitute items of similar or greater value if, for any reason, those stated are unavailable. Props used in images on the Website are not included in a hamper unless otherwise expressly specified.

 

ALCOHOLIC PRODUCTS: Please note that it is a criminal offence for someone under 18 to buy, or attempt to buy, intoxicating drinks, or for adults to buy or attempt to buy on their behalf. The maximum penalty is a fine of £1000. Some of the products offered for sale on this site contain intoxicating drinks. Statute defines a drink containing alcohol as intoxicating if it contains more than 0.5% of alcohol by volume (0.5% abv). In accepting these terms and conditions, if YOU are purchasing products that contain intoxicating drinks, YOU are confirming that you are over the age of 18 and legally allowed to purchase alcoholic drinks and that they are not being purchased for anyone under the age of 18.


5. DELIVERY PROCESS

 

RECIPIENT INFORMATION: In the event of non delivery within the UK due to erroneous recipient information supplied by YOU, or if the intended recipient refuses to accept the delivery, Finest Hampers may make a charge for re-directing / re-sending the consignment.

 

PROOF OF DELIVERY: A signature is required upon delivery to the intended recipient as proof of delivery / receipt by the intended recipient. When a hamper has been signed for Finest Hampers will be deem that all contents are present and have been received by the intended recipient. In the event of any quantity error in the hamper contents please notify Finest Hampers at help@finesthampers.co.uk or on freephone telephone 0800 011 2862 within 3 working days of receipt of the hamper and quote the details set out on the delivery note which the intended recipient will have received with the hamper.

 

DELIVERY DATES: YOU can select a date for delivery of YOUR order on the Website for each recipient when YOU are ordering products. Finest Hampers will use its reasonable endeavours to deliver on the date you select.

 

DELIVERY CHARGES: Finest Hampers's delivery charges are set out in the Website. YOU must enter all intended recipient address details correctly. Finest Hampers is not liable for any delay in delivery or non-delivery arising as a result of incorrect or incomplete addresses submitted by YOU. Missing or invalid postcodes will result in delayed or failed delivery.

 

MISSED DELIVERY: If there is no answer at the intended recipient address then our nominated courier will leave a card explaining that the hamper has been returned to the local depot and an attempt to deliver it the following day will be made.

 

The card will have the address and telephone number of the driver and depot. Our courier will attempt to deliver the hamper the next day. If there is no answer at the intended recipient address then a further card will be left.

 

At this point,, following two attempted deliveries the hamper will be returned to the nearest depot and kept there for approximately 5 working days.

 

If the Depot is not contacted or the hamper not collected from the depot the hamper will be returned to the main point of despatch in Hayes, Middlesex


6. DAMAGED GOODS

 

NOTICE: Finest Hampers hampers are carefully packed to reduce the risk of damage in transit. However, if any contents are damaged when received by the intended recipient YOU must contact the CUSTOMER ENQUIRES within 48 hours of delivery in writing by e-mail to help@finesthampers.co.uk

 

RETURN: Damaged contents should be returned to the address below in appropriate packaging quoting the information contained on the delivery note. Finest Hampers will refund or replace any item(s), if appropriate in the circumstances, following receipt and inspection.

7. LIMITATION OF LIABILITY

 

UK ONLY: This Website is intended only for customers in the United Kingdom. Finest Hampers does not solicit orders from customers outside the United Kingdom.

 

TECHNOLOGY: Finest Hampers has in place checks and measures to ensure that the Products shown on the Website are portrayed as accurately as possible. However, the technology with which you view the Website will determine the image that you see. The images displayed on technology will vary. Finest Hampers cannot guarantee that your monitor's display of any detail of actual merchandise will be accurate.

 

EDITORIAL CONTROL: Finest Hampers will not be liable to YOU or any third party due to the withdrawal of any product from the Website whether or not that product has been sold. Finest Hampers shall be free to remove or edit the content of the Website as it sees fit.

Finest Hampers cannot be held liable for errors with the message or any failure to enclose the message with the product. You undertake that any message you send will not be racist, blasphemous, defamatory or otherwise offensive. Finest Hampers may refuse to send any messages it considers offensive.

 

NO WARRANTY: Finest Hampers gives no warranties of any kind in relation to the Website or any transaction that may be conducted through the Website. This includes but is not limited to: implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade. 1. economic loss (such as, without limitation, loss of revenues, profits, contracts, business or anticipated savings); or

 

2. loss of goodwill or reputation; or

 

3. special or indirect loss arising out of or in connection with the operation of the Website, supply of products or otherwise under these terms and conditions.

 

Finest Hampers does not exclude or limit its liability for death or personal injury resulting from the negligence of Finest Hampers or its servants, agents or employees.

 

Finest Hampers LIABILITY: Finest Hampers's liability for products purchased from the Website shall be limited to the value of your order save in relation to liability for death or personal injury.

 

DATA PROTECTION: Finest Hampers has in place reasonable measures to keep YOUR order and payment details safe. However, unless Finest Hampers is negligent, Finest Hampers will not be liable for any loss YOU may suffer if a third party gains unauthorised access to any data YOU provide. 8. OTHER TERMS

 

ENTIRE AGREEMENT: YOU confirm that, in agreeing to accept these terms YOU have not relied on any representation unless such representation has been expressly made a term of these terms. YOU agree that YOU shall have no rights in respect of any representation. For the avoidance of doubt, Finest Hampers does not seek to limit or exclude its liability in respect of any fraudulent or negligent misrepresentation whether or not part of these terms. These terms form the contract between YOU and Finest Hampers with regard to any aspect of YOUR order.

 

THIRD PARTY RIGHTS: It is agreed that any person who is not a party to any contract between You and Finest Hampers shall not be allowed to rely on or enforce any term of any such contract and the provisions of the Contracts (Rights Of Third Parties) Act 1999 are expressly excluded.

 

WAIVER: No waiver by Finest Hampers shall be construed as a waiver of any preceding or succeeding breach of any provision.

 

SEVERABILITY: If any part of these terms are deemed unlawful, void or for any reason unenforceable, then that part shall be deemed to be severable from these terms and shall not affect the validity and enforceability of the rest of these terms.

 

LAW: These terms and therefore the contract between YOU and Finest Hampers shall be governed by and construed in accordance with the laws of England and Wales and You and Finest Hampers irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
